What Is Bankruptcy Credit Counseling?

The 2005 amendments to the Bankruptcy Code created several new requirements for individuals who want to file a Chapter 7, Chapter 11, or Chapter 13 case. One of the new requirements is to complete credit counseling courses before your case is filed and before your discharge order can be entered.

The pre-filing credit counseling course must be taken by an approved provider within 180 days before your bankruptcy petition is filed. This course assists you with reviewing your finances and makes sure you understand all of your debt relief options. It also helps you create a budget. After completing the class, you will receive a certificate of completion that must be submitted to the court with your bankruptcy petition.

The post-filing credit counseling class must be completed before your discharge order is entered. This course covers topics such as debt management and budgeting tips to help you with your fresh start granted by the elimination of your debt in bankruptcy. Again, you are required to file a certificate of completion with the court.

Both the pre-filing and post-filing courses can be taken online or on the telephone. When the time is right, we will provide you with the contact information for the credit counseling company that we recommend.
